12.36.030 Permit—Requirements.
No building permit for the installation of an awning projecting over public property or a sidewalk canopy will be granted by the building inspector unless the following requirements are complied with:
G.    Stationary awnings or those not normally retracted flat against the building at night shall be provided with artificial light to light all portions of the sidewalk below with at least an average of one and two-tenths horizontal foot candles (lumens per square foot). The lowest foot-candle value at any point below the awning shall not be less than one-fourth the average value provided. Such lighting shall be provided between dusk and dawn each day of the year. Failure to maintain such lighting requirements shall be cause for revoking the building permit.




Title 5 BUSINESS LICENSES AND REGULATIONS
 Chapter 5.06 ADULT-ENTERTAINMENT BUSINESSES, ADULT PERFORMERS AND FIGURE MODELS

5.06.260 Development standards.
The following development standards and requirements shall apply to adult-entertainment businesses, including those providing live entertainment depicting or displaying specified anatomical areas or involving specified sexual activities:
C.     All off-street parking areas and premise entries of the adult-entertainment business shall be illuminated from dusk to closing hours of operation with a lighting system that provides an average maintained horizontal illumination of one foot candle of light on the parking surface and/or walkways. The required lighting level is established in order to provide sufficient illumination of the parking areas and walkways serving the sexually-oriented business for the personal safety of patrons and employees and to reduce the incidence of vandalism and criminal conduct. The lighting shall be shown on the required sketch or diagram of the premises.

15.36.1007 Amendment of Article 10, Section 1007, fire alarm systems.
 Subsection 1007.2.2.2, System initiation, is amended to read as follows:

     Activation of the fire alarm system shall immediately initiate a local alarm (see UFC Standard 14-1) which is audible above the ambient noise level of the assembly occupancy. A single smoke detector monitored by an alarm verification zone, the automatic sprinkler system or other approved fire detection device shall automatically:

  Article III Signs Permitted in Zoning Districts of City
15.148.110 Residential zones.
Within any R residential zone, signs or nameplates are permitted as follows:
 F.     All illuminated signs in the residential zones, including bulletin boards, shall be indirectly illuminated. Directly illuminated signs are allowed subject to approval of a zoning administrator’s special permit. (Prior code § 3.04.061)

15.148.470 Signs located on architectural projections not extending over a public right-of-way.
  B.     Such signs shall not project beyond the face of the architectural projection. Such signs, if illuminated, shall be double-faced signs, with a minimum of four inches and a maximum of eighteen (18) inches between faces. No exposed tubing or incandescent lamps are permitted. All such lighting devices shall be protected by acceptable shatterproof material.

15.148.1170 Generally.
Directly illuminated sign” means any sign designed to provide artificial light directly or through transparent or translucent material from a source of light within or on such sign, including, but not limited, to neon and incandescent lamp signs.

Flashing sign” means an illuminated sign which exhibits changing light or color effect by blinking or any other such means so as to provide a nonconstant illumination.
Indirectly illuminated sign” means a sign whose illumination is derived entirely from an external artificial source which is arranged so that no direct rays of light are projected from such artificial source into residences or streets.

 15.148.190 CBD-SPD and arts and entertainment district boundary.

     Within the CBD-SPD (C-3 zone) and the arts and entertainment district boundary, the following sign regulations shall apply:
  7.     Office Towers—Attached Signs. Signage on office buildings above the street-wall or building base as defined in Section 4.0 of the architectural design guide-lines is allowed subject to the following provisions:
d.     Illumination. Symbols/logos may be non-illuminated or internally illuminated to create a halo backlighted effect. Internally illuminated symbols/logos shall be lighted with white neon tubing and thirty (30) milliamperes transformers.

     Lighting shall not produce a glare on other properties in the vicinity, and the source of the light shall not be visible from adjacent property or a public Street.

     Internally lit plastic signs are prohibited.

  Article XI. Special Signs and Sign Districts
 15.148.860 Freeway—Onsite signs.

     No onsite signs shall be altered or relocated within six hundred sixty (660) feet of the exterior right-of-way line of any portion of a freeway or of a route for a freeway which has been adopted by the State Highway Commission, if the copy of such onsite sign is or would be visible by persons traveling on those portions of the freeway or proposed freeway located within six hundred sixty (660) feet of the sign, unless such signs comply with all applicable regulations of this chapter and with the following additional regulations. Where the regulations of this section conflict with regulations of another section, the more restrictive regulation shall prevail.

  b.     Number. One sign per building of freeway frontage above twenty (20) feet in height. If the building has multiple freeway frontage, the applicant/owner may select which building face on which to attach the sign.

 ii.     Individual solid metal letters shall be applied to the building face

     c.     Illumination.

     i.      Letters may be internally illuminated to create a halo back-lighted effect or nonilluminated. Internally illuminated letters shall be lighted with white neon tubing and thirty (30) milliamperes transformers.

     ii.     Lighting shall not produce a glare on other properties in the vicinity and the source of light shall not be visible from adjacent property or a public street.

  P.     A sign or non-sign illumination mechanism that contains any of the following:

     1.     Neon or neon like material;

     2.     Flashing or non-constant lighting;

     3.     String lighting;

     4.     Rope lighting;

     5.     Spot lighting;

     6.     Fiber optics, or illumination that is not consistent with the historic period between 1849 and 1875.

15.80.020 Personal safety.
   All projects shall be reviewed to determine the levels of public and personal safety provided. Except as otherwise provided in Sections 15.80.030 and 15.80.040 of this chapter, each individual living unit shall meet the following minimum requirements:
  B.     Aisles, passageways and recesses related to and within the building complex shall be illuminated with an intensity of at least twenty-five one-hundredths minimum maintained footcandle of light as measured at ground level during the hours of darkness. These lighting devices shall be protected by weather and vandal resistent covers.

 15.148.790 Alteration or removal of certain nonconforming signs.

     A.    At no cost to the city, signs existing in 1970 and rendered nonconforming by Ordinance No. 2868 shall be removed, or altered so as to comply with the provisions of this article, within the following time limits:

     1.     Within one year from the effective date of Ordinance No. 2868:
d.     Signs emitting sound, odor, or visible matter and exposed neon tubing, incandescent lighting or other artificial lighting or an equivalent effect used for the purpose of outlining a building.

  Article I Use of Public Property
 15.40.030 Lighting requirements.

     All canopies and walkways shall be provided with the equivalent of not less than one hundred (100) watt electric lights which shall be located not more than twenty-five (25) feet apart and shall adequately light the entire length of the canopy or walkway and connecting ramps to the sidewalk.

     When a canopy or walkway is located in or on the public street or alley or located near enough to the edge of the curb to be a hazard to vehicles, red warning lights of not less than one hundred (100) watts shall be placed at each end of the canopy or walkway and additional red lights spaced so that there is not more than fifty (50) feet between such warning lights. Such lights shall be placed on the street side of the canopy or walkway. (Prior code § 9.08.372)

 17.130.060 Development standards.

     The following development standards shall apply to all development, including the expansion of existing buildings, within the Freeport SPD:
     L.     Lighting. The following lighting regulations shall apply in the Freeport SPD:

     1.     Lighting design shall be such as not to produce hazardous and annoying glare to motorists and building occupants, adjacent residents or the public;

     2.     Lighting shall be designed in such a manner as to provide safety, comfort, and security for occupants of the development and the public; and

     3.     Lighting shall be oriented away from adjacent properties within the SPD, shall not produce a glare or reflection or any nuisance, inconvenience or hazardous interference of any kind on adjoining streets or property. In addition, the source of the light shall not be visible from adjacent property or a public street. (Ord. 2004-021 § 1 (part))

 Chapter 8.08 SOCIAL NUISANCE CODE
 If it is shown by a preponderance of the evidence that behaviors occurring on the premises constitute a public nuisance and that the owner of the premises has not taken adequate steps to abate the nuisance as prescribed by the director, the board shall issue a written decision declaring the premises a public nuisance. The hearing officer may affirm, reject or modify any administrative penalty imposed on the owner by the director based upon the severity of the nuisance-creating behaviors on the premises and the owner’s efforts, or lack thereof, to remedy the problem. The administrative penalty may be adjusted if the hearing officer finds that imposition of the penalty would work a substantial undue economic hardship on the owner or tenants. The hearing officer may order the owner to take such action it deems appropriate to abate the nuisance. The actions ordered shall be reasonable and may include, but shall not be limited to:

     A.    Provision of additional exterior lighting;

     Development applications shall be subject to the land use objectives, policies, development standards and design guidelines set forth in the Richards Boulevard area plan. Unless otherwise provided, development within the Richards Boulevard SPD shall be subject to the following special rules and regulations, in addition to the other regulations of this title. In the event of conflict between the provisions of this section and other provisions of this title, these provisions shall prevail.
 (B)   Courtyards and plazas shall incorporate, but not be limited to, one or more of the following features:

     (C)   Courtyard and plaza features shall be complimentary to the building architecture. Design elements, materials, colors, and lighting should be contextual with the proposed building or existing adjacent buildings.

     B.     Aisles, passageways and recesses related to and within the building complex shall be illuminated with an intensity of at least twenty-five one-hundredths minimum maintained footcandle of light as measured at ground level during the hours of darkness. These lighting devices shall be protected by weather and vandal resistent covers.
